A British judge has ordered that the Secretary of State be restrained from returning a Tamil asylum seeker to Sri Lanka during the scheduled deportation via a chartered flight to take place today, 31 May 2012. The judge found that “the recent Human Rights Watch Report dated 29.05.2012 suggests that there may be new evidence relevant to the risk of ill treatment” in the matter of the Applicant’s judicial review application at the High Court of Justice, Queen’s Bench Division, Administrative Court. This finding is applicable to all other Tamil asylum seekers who face the same risks of “arbitrary arrest and torture” upon return to Sri Lanka.
